In July 2006, Mr. and Mrs. John Doe were involved in a motor vehicle crash near Key West, Florida when their vehicle was rear ended by a commercial truck. Earlier that same day, the operator of the commercial truck experienced brake problems and reported it to his supervisor. Because it was a busy holiday weekend, his supervisor told him to drive the vehicle back to their home office instead of safely taking it out of service and fixing the problem. Mr. Doe also underwent surgery for injuries that he sustained to his shoulder and knee following the crash. The primary treating physicians for Mr. Doe opined that he would require ongoing medical treatment throughout his lifetime, including doctor visits, physical therapy, facet block in the lumbar spine and fusions to the cervical and lumbar spine regions. His past medical expenses were approximately $131,000.00.

Mrs. Doe also suffered serious injuries in the same crash. She was a front seat passenger in the vehicle operated by her husband. She had to be removed from the vehicle by the “jaws of life.” She had injuries to her neck, right shoulder, upper back, right wrist, left knee, and low back. Mrs. Doe also experienced significant headaches as well as bilateral jaw pain. MRI studies were positive for multiple disc herniations in her cervical and thoracic spine, as well as in her low back. A board certified neurosurgeon evaluated Mrs. Doe for spinal surgery and recommended that she undergo a fusion of her cervical spine from C4-C7.
