Jury Awards Victim of Serious Rear-end Collision $2,052,434.14 Million


Brevard County, FL - On Friday, a Brevard County jury awarded an Indialantic woman a $2,052,434.14 million verdict for an auto accident that left her with serious injuries and neck fusion surgery.

Cheryl Cataldo was driving her Toyota Corolla on State Road A1A near the intersection of Coconut Drive in Melbourne, Florida, on the morning of September 23, 2005, when she was rear-ended by David S. Ori who was driving a delivery box truck,  a company vehicle for First Health Inc. of Brevard County.

Mr. Ori was distracted and collided into the rear of Ms. Cataldo’s vehicle, which was slowing to make a turn at the intersection, as she headed home from the gym.  As a result of the accident, Ms. Cataldo, 47, sustained serious and permanent neck injuries, which resulted her having to undergo a multi-level neck fusion surgery.  Her treating doctors have also advised that she will require ongoing regular therapy, as well as additional surgery to her neck in the future.  In addition, the devastating injuries left her incapable of continuing her employment as a dental hygienist, a career that she had enjoyed for the preceding 8 years. 

“We are pleased that the jury saw Ms. Cataldo’s need for justice,” stated Palm Bay attorney O. John Alipzar of Alpizar Law. “These types of accidents should never have to happen. Florida roadways are dangerous and drivers must pay attention at all times while driving.”

“Sadly, this unfortunate circumstance has left her incapable of enjoying the independence, both financially and socially, she enjoyed previously,” added attorney David Alpizar.  “She was an extremely physical woman, which has been significantly affected by this situation. 

Ms. Cataldo’s attorneys, O. John Alpizar and David Alpizar, filed suit in the Circuit Court of the 18th Judicial Circuit for Brevard County, Florida. After a two-week trial a jury returned a $2,052,434.14 million-dollar verdict in favor of Ms. Cataldo.
